Used to own two CD stores for 11 years that were partially put out of business from the file sharing of music so this is a topic near and dear to me.
While I agree with Lessig’s premise that copyright is a huge issue, his argument that the 5% decline in CD sales compared to the 5 times increase in file sharing does not justify limiting the latter is rather weak. If a business’ product sales decline 5% a year, it is not going to be very long before the business ceases to exist. He also ignores the very real probability that the CD sales would have increased by 5 times or some other factor (rather than decline) were it not for the free sharing of music on the net.
Furthermore if there is no financial incentive on the part of artists to be creative, this will serve to diminish creativity rather than the opposite which is also part of Lessig’s argument.
On the other hand I am all for new technologies and if there comes a day that file sharing and artist remuneration can coexist peacefully, the fact that technology has made music stores and perhaps music labels obsolete is fine with me.
Totally agreed. Artists must be compensated and it is rotten that small businesses suffer most. That piece is somewhat dated now, 2002 was light years ago in terms of p2p. He is very radical though and and still suggests something beyond capitalism as a solution to the ‘copyright wars’.
